Guardian Agreement
Effective October 23, 2026. Version 2026-10-23.
A parent or legal guardian accepts this agreement before a member under 18 can use Tethrd. By accepting, you confirm that you have legal authority over the member, you accept the Teen Terms on the member's behalf, and you take responsibility for supervising the member's use of Tethrd. In return, Tethrd adds you to every conversation the member has, sends you a copy of every message, and lets you approve introductions and applications, stop any conversation, and ask us to delete the member's account. Nothing in this agreement releases, limits or waives any claim the member has, or any claim you have because the member was harmed.
1. Who we are and what this agreement is
This agreement is between you and NovaHawk Labs LLC, Series Tethrd, which runs Tethrd. NovaHawk Labs LLC, Series Tethrd is a protected series of NovaHawk Labs LLC, a Texas series limited liability company. Under Texas law, the debts, liabilities and obligations of NovaHawk Labs LLC, Series Tethrd can be enforced only against the assets of NovaHawk Labs LLC, Series Tethrd, and not against the assets of NovaHawk Labs LLC generally or of any other series of it. This does not reduce what NovaHawk Labs LLC, Series Tethrd itself owes you or the member.
In this agreement, "the member" means the person under 18 for whom you accept it, and "you" means the parent or guardian accepting it.
2. Your authority
You confirm that you are 18 or older, that you are the member's parent or legal guardian, and that you have the legal authority to consent to the member's use of Tethrd. You must accept this agreement from the email address the invitation was sent to.
Your link becomes active only after the member's community confirms you, by its roster, by an admin who knows your family, or by a small card authorization. This confirms the link for Tethrd's purposes; it is not a check of legal identity or custody, and it does not replace your own statement of authority. If what you confirm here is not true, we will end your link.
3. Accepting for the member
You accept the Teen Terms on the member's behalf and consent to the member using Tethrd under them. The member also accepts the Teen Terms. Because a person under 18 can generally cancel their own agreements, this agreement makes you, as an adult, responsible for the member's use of Tethrd.
You give us, for the member's content, the same limited license the member gives in the Teen Terms: to store it and show it only to the people Tethrd shows it to, including you and the member's other linked parents, in order to run Tethrd.
4. Your responsibilities
You agree to: supervise the member's use of Tethrd in the way you judge best; help the member follow the Teen Terms; keep your email address working so that message copies reach you; tell us at support@tethrd.us if you believe the member is at risk or someone has broken the rules; and follow the conduct rules in the Member Terms when you write in the member's conversations. The contact-details block applies to your messages too. Use message copies to supervise the member and to report concerns; do not publish other people's messages.
5. Court orders, custody and more than one parent
You agree to tell us at support@tethrd.us promptly if a court order limits your authority over the member or your right to see the member's communications. Our support team will then end your link. We may also end a link if we receive information that the person linked does not have authority over the member.
Up to three parents or guardians can be linked to a member. Each one is confirmed the same way. Every linked parent sees the others' links and is told about any change. Any one linked parent can approve an introduction or application. Any one can decline, stop a conversation or request deletion, and the most protective request wins. A member who has a problem with a linked parent can contact our support team, who may end that link.
6. Copies of messages
While your link is active, you are added to every conversation the member is in, and you get a copy of every message sent to or from the member, by email. A parent who is confirmed later is added to the member's open conversations. You cannot turn these copies off. Before an adult sends their first message to the member, Tethrd tells them that you are copied. You can write in the member's conversations; your messages are labeled "Parent".
If email to every linked parent stops being delivered, the member's conversations are paused until a parent confirms their email by signing in. Copies already delivered cannot be recalled.
7. How long messages are kept
Members cannot edit or delete messages. Messages in conversations with the member are kept until three years after the first day of the month after the member turns 18, then deleted, unless the law requires us to keep them longer. A moderator can remove a message that breaks our rules.
8. Approvals, Stop contact and ending your supervision
An introduction to the member, and the member's application to an opportunity, wait for a parent's approval. The other person sees nothing until a parent approves. A parent's decline is final for that introduction or application.
You can stop any conversation with the member at any time. This closes it. Leaving a conversation as a parent also closes it.
You can end your own supervision. If no linked parent remains, the member cannot send or receive messages until another parent is confirmed.
9. Deleting the member's account
You can ask us to delete the member's account at any time from Settings. The member and every other linked parent are told. We delete the account within 30 days, usually overnight, and you can cancel your request until then. Messages the member sent stay in the other people's conversations, shown as from "Deleted member", until the retention date in section 7. If no parent is confirmed within 14 days of the member signing up, we delete the member's account automatically.
10. Optional uses of the member's data
We use the member's data only to provide Tethrd. Any optional use would need both your choice and the member's own choice, asked separately, with "Decline" as the default. Tethrd has no optional uses today.
11. When the member turns 18
Your link ends, and you stop getting copies, on the first day of the month after the member's 18th birthday. We tell you and the member at the start of the birthday month. Copies you already received stay with you. The member must then accept the adult Member Terms, which do not change anything that happened before the member turned 18.
12. What Tethrd does and does not do
Sections 6 to 9 describe how Tethrd works. They describe safeguards, not results. We do not read messages as they are sent, we do not run background checks on members, and communities decide who joins them. Members under 18 cannot post opportunities, cannot see opportunities above their age or awaiting a hazard review, and cannot be introduced to other members under 18. When we learn of apparent child sexual abuse material, child sex trafficking or online enticement of a minor, we report it to the National Center for Missing and Exploited Children as federal law requires. You or the member can report any profile, message or opportunity, and we aim to review reports about members under 18 within 24 hours.
13. The member's own legal rights
Nothing in this agreement, the Teen Terms or the Member Terms releases, waives or limits any claim the member has against us, or any claim you have arising from harm to the member. You do not promise to pay us anything because of a claim brought by or for the member. The limits on liability, the jury waiver and the responsibility for claims in the Member Terms do not apply to those claims.
14. Your own claims
If someone else brings a claim against us because a statement you made in section 2 was not true, you will pay our reasonable costs of that claim, including reasonable attorney's fees. This never applies to a claim brought by or for the member.
For your own claims that do not arise from harm to the member, our total liability to you is limited to $100, and we are not responsible for indirect or consequential losses. This limit does not apply to claims for death or bodily injury, to losses caused by our fraud, gross negligence, recklessness or intentional misconduct, or to our liability under the New Jersey Consumer Fraud Act, the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act, or sections 349 and 350 of the New York General Business Law.
If you also use Tethrd as a member of a community, the Member Terms cover that use.
15. Disputes and governing law
You keep your right to go to court, including your right to a jury trial. We do not use arbitration. Before filing a claim, please email support@tethrd.us so we can try to resolve it within 30 days; you do not have to wait if you need urgent relief, a deadline is near, or the claim qualifies for small claims court. You may bring a claim against us in the state or federal court for the county where you live, or in the state or federal courts in New Jersey. We will bring a claim against you only in the court for the county where you live.
New Jersey law and applicable federal law govern this agreement. If you live in New York, you also keep the protections that New York consumer law gives you.
16. Changes and general terms
When we change this agreement, we post the new version with a new effective date and ask you to accept it before you continue. If a change reduces your rights or the member's protections, we will tell you by email at least 30 days before it takes effect, unless the law or a safety need requires it sooner. A change does not apply to a dispute that arose before it took effect.
This agreement ends when your link ends. Sections 7, 9, 13, 14 and 15 continue after it ends. If a court decides that part of this agreement cannot be enforced, the rest stays in effect. We send notices to your email address and in Tethrd; send notices to us at support@tethrd.us and, for legal notices, also by mail to 1122 Colorado St, Unit 1410, Austin, TX 78701.
